Me and my wife live with my father to take care of him due to his health. He recently got a divorce, the mortgage and the deed are still under both him and his ex's names. The divorce decree states he gets the house but a quitclaim has not been filed. My father has alot of medical debt and still owes on the mortgage. He says he wants me and my wife to take over the house when he dies but at this time the will still states the house goes to the ex, I am not on the deed or the mortgage. The ex does not want anything to do with the house but will not sign a quitclaim until her name is off the mortgage. The house is in need of alot of work but i am not willing to put money into the house unless i know if there is any chance I will get the house when he dies. I am wanting to find out if the ex is going to have the mortgage company coming after her, if the house will have to be sold to pay off the medical debts or if i will have a chance to get the house.

Hi jwcaudle,

Welcome to Mortgage fit,

If you and your wife have a good credit score and good income history then surely you can put a proposal to your father and his Ex.that you wishes to refinance the mortgage on your and your wife's name and thus your father's Ex. should sign the quitclaim deed...

Now next step is to find out whether do you get pre-qualified for the refinance...just check this out with our lenders on this community...
