My Grandma wants to quit deed her house to me as she is getting too old to deal with the property and tenants. The property is in Miami Dade, my grandma lives in Jamaica and I live in the UK. Do we both have to go to the States or can we sort it out from where we are? There is also an outstanding mortgage of about $20,000. Can this also be transferred to me?

Hi charlene_mc,

Hi welcome to Mortgage fit,

As far as transfer of mortgage is concerned,you won't be liable to pay the mortgage,it will still remain with your grandma.So if you wish to pay the mortgage as a courtesy,you can do so,but you are not held responsible for it if you do not pay it.

As far as your first question is concerned I am not sure whether county where the property is located does have any sort of this online recording service...most probably it will not be, to prevent unlawful practices.

Can the house be transfered to me whilst the mortgage still remains with my Grandma or do I have to take on the debt aswell? I've heard of Novation elsewhere on this forum. Is this something that you think could be available to me?

Hi charlene_mc ,

Only 20K is remaining and i don't see any reason that your grandma will not continue to pay it off.So if she assures the lender about it then there is no need for the refinance on your name.You can just ask your grandma to sign the quitclaim to you.and you need to be present personally to file it at county office.

As far as novation is concerned in this scenario I won't think this process will be applicable.for further information on Novation you may visit this link.
