I am wanting to remove my name from a deed that lists me and my aunt as joint tenants. The land is in New Mexico. Do I need to fill out the quitclaim deed and/or different paperwork. Also, is there a different form for New Mexico vs. California where I'm at?

No, there is no different form as such....You just need to file a quitclaim deed. and that is sufficient enough to transfer the property rights irrespective of any state you are living in.

Hi hulamom!

Welcome to forums!

You can use a quitclaim deed form to remove your name from the property deed. You will have to sign the deed in your aunt's favor and then notarize and file the quitclaim deed at the county recorder's office.

Quitclaim deed form varies from state to state. You should contact a real estate attorney based at New Mexico and he would help you in drafting the quitclaim deed.

So I filled out a form for California as that is where I live. Do I file it with our county clerk or send it to my aunt in New Mexico to file it there.
