My Husband and I are seperating and he told me that I can have the house. He does not want me to buy him out. I want to know is the Quit Claim Deed the document I need to get this procedure started?

Yes, you can ask your husband to sign a quitclaim deed and give away the interest in the property. Make it a point to record the deed in the county recorder's office. However if the house has any mortgage, then you will either have to refinance or you will have to go for the process of novation to transfer the mortgage in your name.

Signing a quitclaim deed will be an easier and better option for you. Go for refinancing if the house has any kind of mortgage.
