me and my x purchased a house in tx she lives in the house I dont. she is wanting a quit claim deed. I am wanting something to get my name awayfrom the financing, aswell as the house note what should I do. her credit is not strong enough to refinance. she is trying to do a mortgage modification and is demanding that I sign a quit claim deed. the company handling the billing will not honor a novation. because they are not the lender they are just the people that handle the payments and questions. I am in diar need of your expertise.

Hi brthomas,

If you want to remove your name form the property deed, then you will have to sign a quit claim deed in your ex-spouse's name. This will transfer the property in her name. As far as the mortgage is concerned, your ex will have to refinance the loan in her name. Merely signing the quit claim deed or doing a mortgage modification won't help you in removing your name from the loan.
