how do i get someone off a quick deed when divorced?I hold the mortgage

If both you and husband ,when married, were on the Mortgage note and title you will have some steps to radicate this problem.

The first thing you want to do is have your husband sign a quit claim deed which would aleviate him of all the interest in the property. Then you will need to contact your lender and advise them of the change. To get him off the mortgage note all you will need to do is a refinance with you as the sole borrower.

If he is not on the mortgage note then all you need to do is get him to sign the quit claim deed. Hopefully you will not have any difficulty getting him to sign the deed.

Talk to your lawyer first.

Who is on the deed? Are you only one who is on the mortgage?

If there are any other persons on the deed then he/she will have to sign the quitclaim deed. By the way you should elaborate your situation a bit more so that we can give a better answer Smile

If your former husband is on the title of the property that means he owns half the house. He can quitlaim it to you if he has no mortgage responcibility on it. Talk to your divorse attourney.
