I divorced in 2004 and I was awarded in my divorce decree the house. I obtained my own mortgage right after the divorce. My ex-husband was at the closing and signed papers to transfer the property or so it seemed.

Fast forward several years and I went to refinance my mortgage and was told that the title was still in my former married name and that my ex-husband's name was still on the title. Note that my ex-husband died after our divorce.

Question:

How do I remove my ex-husband's name from the title and what are the issues since he has died? Also, I assumed that the title company would have had the title updated at the time of our divorce. I do not have a quitclaim deed showing that this occurred. I assumed that is what my husband signed at the time of closing.

Hi Guest,

You need to contact an attorney and check out how you can remove your ex-husband's name from the property deed. The real estate attorney will guide you in this matter. Unless there is a quitclaim deed in place, the title company won't update the property deed.

Yes,
Quitclaim deed will be the best option.
