Remove name of Deed?

My husband 58 refinanced our home without my knowledge until the bank realized that my name is on the deed. I signed only papers giving him permission, however if he defaults or dies within this thirty year morgage I will be responcibile, correct? Should I get a quit claim deed since I plan to divorce him. I have no say about this house, nor is this my dream home.

have you signed any mortgage paper? if not, you are not answerable for it.

Hi Doretta,

Signing a quit claim deed will only help you remove your name from the property deed. If you've signed the mortgage documents, then you're responsible for the mortgage dues. In that case, your husband should refinance the loan solely in his name to release you from the liabilities of paying the mortgage.
