Can a Quit Claim be performed retroactive?

My ex-wife was to have been paying her portion of a mortgage for 8 months per a court order, and has neglected to do this. I have paid all financial encrumbrances for that period. I'm wondering if she can quit claim her share of the property to me retroactive to 8 months ago?

Welcome to the forum.

Is it that your wife were supposed to quitclaim her share of property to you? Then she can quitclaim to you and you can simply refinance the mortgage on your name. Whatever she has paid in these 8 months, you can give it back to her.

BTW have you consulted with any attorney yet? If not then you should do ASAP.

the date of a document is the date of the document.

that being said, whatever legal agreement you have will reflect the date of the intended transfer.

what purpose are you trying to serve here, gchevlin?
