we own a time-share,mortgage free-wish to give it back to the seller/developer. Will the quit claim deed work? can we complete the form, send back the title with the form and be released from the timeshare? Should we file the quit deed at the county clerk office where the timeshare is located prior to sending it?

you would be smart to discuss this with the seller/developer to see if it fits in with their plans.

Welcome to forums!

You can transfer the timeshare to the seller developer by signing a quitclaim deed in their favor. You can record the quitclaim deed at the county recorder's office as it will make the deed valid. However, the deed should be recorded at the county recorder's office where the property is located.

Once the Quit Claim Deed is filed, can we fedex the quit claim deed with the deed to the timeshare? If yes, should we send it to the sales office at the timeshare? Would it be wiser to file a Warranty Form? Our concern is that we will be held liable for the maintenance and dues for the upcoming yr.

your fears are precisely the reason i suggested you discuss this with the seller/developer to begin with. your liability isn't over just because you stop making payments and give it back to them, you know.
