in 1996 unawarely my sister quit claimed her property to me and my older sister who is a u.s. citizen but staying back home. my sister did this because her in-laws forced her to do it because her father in law wants to buy a house for them but she needs to give up the other one. without consulting me if i want to take the responsibility and to include my other sister on the deeds she just followed what her in-laws told her to do. so i have no choice but to continue paying everything just to keep the property without my other sister help. during that time my sister has the money and if she really wants to pay in full it is possible but she did not so i have to work hard just to pay the obligations. she never offered any help to me. in 2004 this sister of mine came back to america and asking the 50% share on the property. she is threatening me and even wanted to kill me that time so i went to the court to get a restraining order and it was granted. i am blaming my younger sister for giving me this problem but all she has to say was it is already done. just last week she called my younger sister again and threatening to bring this to court and that we will be getting a letter from a lawyer. so is there a way that my younger sister can do to help me out of this trouble? actually now, i am having problem paying the mortgage because i got disabled in 2002 and to this time never been back to work. life is not easy to me nowadays. so if you can give some suggestions or advise i do really appreciate it. thank you very much.

Hi elg,

Your younger sister has quitclaimed to you. It can be reversed only if you quitclaims back to her. Are you willing to quitclaim the property back to your younger sister as you are not being able to continue the payments?

Why doesn’t your elder sister make any contribution on the monthly mortgage payments? And the most important question is, who is on the mortgage only you or both you and your elder sister?

yes i am wiling to quit claim back to my younger sister. and regarding our older sister to be honest with you she's greedy. she just want to receive and nothing to give. she doesn't care. all she knows is her name is on the title so whether she contribute to the expenses or not is like who cares. when our mother was still alive the loan was under her name but i accept the responsibility and ask the bank to add on my name so now it is under my name thinking that i will never have a problem like this. i just hope that there will be a law that will protect people like me from greediness whether it is your husband, wife, relative or member of your own blood, friend who are taking advantage because their name were added onto the title but does not want to contribute as far as expense s are concern. thank you very much for the information.

Hi elg,

Welcome back.

I really don't blame you because your intention was good but you have messed it up. You can only quitclaim your share of the property to your younger sister and even then you will be on the mortgage. Means paying mortgage will be your responsibility if your sister don't refinance it on her name. So better consult with your sisters and try to refinance the mortgage to add all three of you on the mortgage as all of you are the owner of the property and ask them to contribute on the mortgage payments.
