My name was placed on a quit claim deed by my father who passed away a few years ago. The property was auctioned off without my knowledge. On the quit claim deed it stated on one part "All of the right, title and interest of the Grantor in and to the lands situate in Citrus County." I did receive the interest but my question is do I still have any right to part of the property since it was auctioned off? I don't know how I can find this information out. I do know that the title isn't free and clear and was wondering if its because I own a part of it even though it was auctioned. Thanks.

If a person gets a property through quitclaim deed, then he has an interest as well as ownership rights on the entire property or a part of it. So, if someone auctions the property without the knowledge of the grantee or current owner, then this is not legal.

Hello Magnetlady,

It is really surprising how your property gets auctioned off without your consent.
Was there any loan against the property as you said that the title is not clear?
I don’t think you have any more right to the property once it has been auctioned and as you have already received the interest. But still you can consult an attorney to find if you can stand against the illegal auction with the proof of your quit claim deed.

If your father quitclaimed the property to you then there should have been a document sighned by you and recorded with the county. If this has been done then you would have been contacted by whomever was trying to sell the property. If you have recieved proseeds from the property that means you sold it so there should have been some documents you have sighned to that effect. If none of this or some of this has not happened you need to figure out why. Then you can determine whether you still have interest in the property and some one might be liable for fraud.

now that a quit claim deed happen between you and your dad, why did a auction happened without noticing you actually.?

The Citrus County courthouse told me that a certified letter was sent to me in regards to the auction which was held to pay off past taxes but the letter was sent to the address of my dads property which was auctioned but I live in Ky. I didn't know if I had anything more than the interest in the property that was sold at a tax deed auction because I received a certified letter from a gentleman that said the lot doesn't have a clear title and will not have clear title until 3 yrs has passed from the date the property sold at auction which was 7-12-06. I'm wanting to know how I can find out about this cause if I still have rights to part of the lot then I want to sell it before this 3 yrs. is up.
