my boyfriend was sued successfully by his ex wife for over 8000 dollars for the second mortgage on the house they had together while they were married. He signed a quit claim before they got divorced, she lived in the house while they were divorcing until the house sold, he moved out. She cried to him about almost losing the house because she couldn't pay for the house payment and mortgage. He sold everything he had to help her to keep the house. In the end they did divorce and the house was sold, she moved out. She brought him to court and won the case. He has to pay her the $8000+ and child support.

Hi karma,

I don't understand on what ground she sued your boyfriend. I understand the child support part, but she used him for $8000+ for a second mortgage! Who were listed on the second loan? Your boyfriend only or both he and his ex-wife? Your boyfriend quitclaimed the property, which means he transferred the property in his ex's name. Did the divorce decree left him liable for the second loan? Was he ordered by the court to make payments towards the mortgage debt?

you answered your own question in your post, karmacara. if the ex-wife successfully sued him, then it's clear that it can be done. there are obviously far more details than we've seen in this case. a court of law seems to have agreed with her, so she won. perhaps if we knew all the details, we'd agree, too.
