I am separated from my husband - not legally, but definitely. He does not make good financial decisions and I want to get his name off our house so that liens, etc., could not be attached to this house. His name is no longer on the loan. Is a quit claim the most secure way to transfer his name off of this property?

Hello Elizabeth,

You may use a quitclaim deed to remove your husbands interest in the property and give it to you since he is not listed on the loan there should be no issues. Be sure to have the deed notarized and recorded at your county office.

yes, you can sue a quit cliam deed to settle this.
