| I filed for divorce and after our separation he has run up credit and has stopped paying the court ordered bills he is responsible for. He wants me to sell our home that our children and I still live in, I don't want to sell until he fixes everything he left undone, which should be fixed before I try to sell. My daughter has a year and a half left of highschool and I want to sell when she is done and get fair market value. He has conceeded all the proceeds of the sale to me but I wish to split the profit 70% me 30% for him so he can gain financial stability by paying off some of his debt. I feel like I am being more than reasonable but am afraid of what his poor spending habits and accumulated debt could do to the property in relation to asking him to sign a quit claim deed. I am in New Mexico. |

You need to get back into court if he's not paying the court ordered bills. A Judge won't make you move as long as your children live in the house, but your credit is getting destroyed if you're both on the Note. You should have re-entered court as soon as he stopped paying the bills ... his behavior is unacceptable.
Where does he expect the children to live if the house is sold? _________________ Raymond
