I have a friend have a house in both his and wife (now deceased name). Without his knowledge the wife refinance on the home and file a quit claim deed to their daugther-meaning the deed was in the wife and daugther name. He never signed over his right of the mortgage. The wife this deceased and the daughter kick the father out of the house stating that the house is now her. He let his wife and daugther take cares of the bills which he just gives the cash when it needed. Basically he really don't know the money actually going, since he paid with cash. I suggested he need to get legal advice to see if he can sue the daugther regarding ownership of the property and evicting him illegally. I need an answer ASAP!

Hi,

I agree with you. Your friend needs to consult a lawyer in this situation. If he says he never signed his rights to anyone, it suggests his wife had fraudulently transferred the property to her daughter. If that's what happened, then he needs to look for legal options to reverse the fraudulent transfer. But he will have to have enough evidence to establish his claim that the transfer was indeed fraudulent.
