Is a quick claim deed ever illegal?

My mother's assets were in a trust with all siblings name on the trust documents. My brother who is the trustee is now the sole owner of her house. She has Alzheimers disease. He recently took out a $325K loan without our (brothers/sisters' consent or knowledge). Documents states it is a Quit Claim Deed. Is that legal?

It depends on how the trust was structured......if all the siblings had a controlling interest in the trust.....then chances are what he did was not legal......I would suggest you get a copy of the quick claim deed.....and take that and the trust to an attorney......

Hi Mseo,

Welcome to the forum.

I agree with Cedric that it really depends upon "how the trust was structured". If all the siblings are co owner of the property, then it was illegal. But if he is the sole owner of the property, then it was ok. But I would request you to review the deed by an attorney.
