my husband and i separated he quitclaimed the house to me, do i need to remove his name from the original deed?

Hi Marcia,

Welcome to the forum.

When your husband has already quitclaimed the house to you, it means that you have gained complete ownership over the property. Now his name which is still on the original deed will hardly matter.

Yet if you want to remove his name from that original deed, you need to file an affidavit of heirship. This will help you to remove his name from the deed.

Hi Marcia,

Welcome to Mortgagefit discussion board.

After the quit claim deed is notarized, you need to get it recorded with the county recorder's office. At the recorder's office the original deed will be replaced by this new deed.

So this process is removing his name from the deed and replacing it with yours. Now this new deed is the original deed for your property.
