An ex girlfriend, who lived with me, gave me $10,000 to use for the refinance charges when I refinanced the house. It was a verbal agreement for the money she stole from me. At the closing she stated on paper that the money was a gift. A few months later we broke up and she moved out. She put a Claim of Interest against my title and I can not refinance the mortgage which is under water today. If I quitclaim deed my interest to my now wife, will it remove the Claim of Interest my ex girlfriend put against my title about 5 years ago? I was told they do expire but they stay against your title.

Hi Frank,

Though you quitclaim the property to your present wife, it won't remove the lien from the property. If you want to remove the lien, you will have to pay the amount to your ex-girlfriend. You can even contact an attorney and take his help in this matter.

Hello Frank,

A quitclaim deed may be purchased for a small sum as protection against the possibility that the grantor has a substantial interest unknown to him. So its better ask an attorney.
