Ex will not refinance

Posted on: 17th Jul, 2009 12:51 pm
my exwife will not refinance our family home and now me and my new wife can not buy a home. she really does not have the credit to do it and that is why i think she keeps putting it off.

if i am the buyer and her the cobuyer can i go and refinace under my name without her knowing and then give her a choice to refinance or i sell the house?

it has been 4 years and i did not want is to come to this because i have a child involved but i do have a new family that needs a home too.
Hi JimeZ,

As your ex-wife is the co-buyer, she can definitely refinance the house in her name and release you from the liability of the mortgage. But if her credit is not good, she will not be able to do that. Are you the only one on the loan? Or is your ex-wife also on the loan? If your name is the only name on the loan, you can talk with your existing lender and try and sell the home to pay off the current mortgage.

who wants to keep the house? it will be difficult for your ex wife to continue because if credit problem. now if you want to continue, you can own both house & mortgage in your name. discuss it with your ex wife.

however if you are not interested, selling is the right option

if you can convince your ex wife then you can have propety transfer to your name.

Just discuss with her and get solution.
