We are closing Tuesday so time is short. We live in alabama. My husband is signing of the property that our house is on. I do not want him responsible for this loan. The bank said he had to sign because of alabama code because he lives here but that he is not responsible for the loan yet they have his name on the papers. I obtained a non-applicant agreement which as I understand makes it clear that he is not responsible for the loan. I need to know if anyone knows about this.

Hi aussielady,

If you are refinancing the home in your name and you qualify for the refinance, I do not understand the reason why the lender wants your husband to sign on the mortgage papers. If he really needs to sign on the papers, he should not sign on the mortgage note. If he signs on the mortgage promissory note, he will become responsible for the loan. Unless he signs the mortgage note, he cannot be held responsible for the debt.
