My ex husband was ordered by a judge during divorce trial to refinance house within 3 months or put it on the market for sale to give me half of equity. It has been nearly a year and neither has taken place. He wants to stay in house but cant qualify. He wants to pay me cash out and I sign a quickclaim deed, but wouldnt I still be obligated in the eyes of the mortgage company? I understand it as nothing would change as far as my obligation to the loan goes but i would not be intitled to the home

Hi Rhonda,

Welcome to mortgage fit,

if you only sign the quitclaim deed now and later on he does not refinance then you will be liable for the mortgage at the same time you are not owning your share in the property.

You should ask your ex to sell the home and later on with all deductions towards mortgage, you will get some cash.you can then be cool because later on your worry about mortgage payment will be over..
