I will be filing for divorce and I am 5 years into a joint mortgage in his name first, mine second. Propoerty was about $110,000, A qquestion that I have is could he refinance it?? If I can do a quitclaim deed before I file for divorce, please advise me. He does not want to move again and I think will be accept handing it over to him. Foreclosure is a last resort, but I want out, and don NOT ask for anything in return. My work, day removed numbers
So, you wish to move out and hand over the property to your spouse? ok, a quitclaim will help in transferring the property to him. But you can execute the quitclaim simultaneously with the refinance. Check out the faqs on refinance prior to going for it. _________________ Procrastination is the enemy of your financial sucess
do the quit claim in title on the condition that he refi.
Do NOT quitclaim and remain on the mortgage.
