my father is on title of my house and the mortgage is in my name only but he had to sign in some places on it when i tried to refinance he is refusing to sign can i still refinance without him if not how can i get him off title he wont sign a quit claim either

Hi phjmmt!

Welcome to forums!

If your father does not sign a quitclaim deed, then you won't be able to remove him from the property deed. Your father has to sign a quitclaim deed in your favor and get the property transferred to you. If your father's name is not on the mortgage deed, then you can refinance the mortgage without his signatures. You need to go through the mortgage docs and check out if he is listed as a co-borrower of the mortgage.

You can't, but a Judge can. You'll have to go through the legal process to get it done - but the Judge won't remove him unless it's justified, so review your scenario with an Attorney first and get her opinion.
