My Responsibility for the house.

Posted on: 31st Jan, 2009 02:46 pm
The deed for my husband and my home has both our names on it. Several years ago we were separated. During this time, he refinanced our home on his own. The loan is only in his name. The finance company has told me that I can stay and pay or leave. If I walk away from this home, am I liable for the loan?
Hi,

You won't be liable for the loan because the mortgage does not have your name in it. Also, find out if the deed still has your name. Even if it is there, it's not going to affect you in case your ex defaults and you walk away.
