This is the house I grew up in since 7yrs. now being 45. My stepdad's health was failing and wanted to help me by giving the house to me as he was moving into a facility. He did pass away in Jan of this year and had made clear to lots of people that he wanted the house to go to me. He almost had the deed transfered into my name but then went into the hospital in Nov '09 and never came out. Since then, His wife has agreed to let me have the home and even gave me money to fix it so we can move in. Last week, she has finally moved to Charleston and we are waiting for the estate to be approved. She does not know how to go about this transfer of names and we are wanting to fix up the home so we can move in. Can you help us on the steps we need to take to get this moving along so I can get ownership and start repairs to move in? Thank you for your time with this. Sincerely, Cari Coy

Hi Cari,

If the property is in your step-father's name, then you'll have to file an affidavit of heirship at the county recorder's office and get the property transferred in your name. You can contact a real estate attorney and he will help you further in this matter.
