I am in currently in the process of refinancing my mortgage. I am newly married and my husband is in the military and currently serving in Afghanistan. The problem lies in that TN is a spouse state and they are requiring his signature on the Title, and obtaining a Power of Attorny from him in Afgahanistan will take about another month. Is there anything else that I can do, to close on this mortagage, other than wait to recieve a general power of attorny.
Does the quit claim deed apply to currently married couples? Or is there any kind of variance we can get in order to close on the loan.

Hi Amy,
Welcome to the forum.
Your husband can quitclaim to you but in that case you will have to take the loan on your name and only your income will be considered - not your husband's income. So do you have good enough income to qualify for the loan?

| My husband wants a divorce, we refinance our home two years ago, my question: When I signed on the quick claim deed was that for the first loan to obtain the refinance loan, did I sign off on my rights for the refinace loan? |

Hi Michaela,
You need to check out the quitclaim deed and find out if your name is mentioned on the deed as a grantee or not. If you are one of the grantee's to the property, then you are still the owner of the property.
