I live in TN. My divorce is final on December 21, but I am buying a house (by myself) before November 30. Would a quit claim secure that my ex-husband cannot have ownership in any way to this house? We have no other mutual assets or children...it's a pretty cut and dry divorce. Where can I find a simple quit claim form that I can take to the divorce hearing to give to the judge? is this all I would have to do or should I file it with the divorce papers that are already on file?

Hi Lauren,

As far as I know, Tennessee is not a community property state. So, if you purchase a property in your name now, your husband will not be able to claim any ownership to it. However, to be on the safer side, you can consult a real estate attorney and take his opinion. Moreover, an interspousal transfer deed would be a better option in your case rather than a quitclaim deed.
