My father and I are joint tenants with right of surviorship. This home was previously owned by him and my mother prior to her death. My father remarried a year after her death and wanted me to sign a quit claim deed so his new wife's name could be placed on the property. I did not do this. Looking at tax records the other day, I see he and I are no longer the owner, but his wife and son. I have a copy of the quit claim deed where he transferred ownership without my knowledge. Is this legal? The property is located in Tennessee.

Hi Guest,

Your father can transfer his part of ownership. but not yours.

Something has gone wrong. you need to contact Attorney in your Town

He can't transfer your share if property is disbursed. then its illegal.If your name mentioned on deed, Then you have to take help of attorney & follow his advice.You may take help of court. If you have proof of your ownership of property as you say you have copy of quite claim deed.

Thanks for your help. I didn't think this could be done. Yes, I do have a copy of the Quit Claim deed where the property was quit claimed to me and my father and I also contacted the registers office and received a copy of the deed when he as grantor gave it to his wife and son.

Your name cannot be removed from the property deed without your signatures. If your father has done so, then it's illegal. You can sue your father for using illegal means to remove your name from the property deed. Contact a real estate attorney and he would help you in taking the right decision.
