I am 90 days late I have tried everything to negotiate.
So in Texas where my house is how long before they start Auctoin or foreclose on me?

Hi maryescajeda,

Welcome to forums.

Usually the lender files a notice of default within 90 days of a single missed payment. Within the next 90 days, you need to pay off the loan or else the lender sends you a notice of sale. And within 15-30 days of sending the notice of sale, the lender arranges for the foreclosure auction.

Mary welcome to Forum,

As James said but coined differently,

Being late on your mortgage payments does not resort to foreclosure. You will have to be delinquent. Meaning you have to be past due on your mortgage payments. Usually when you are 3 or more months behind in payments you will, depending on the lender, get a notice about foreclosure process.

Hopefully you will not be going in that direction. Just continue making your payments on time. The late payments will affect your credit score making it hard to get a good loan if, down the road, you are considering refinancing.

Hi,
In the state of Texas if you are already 90 days past due and you have received a Default Notice from the lender and that has expired. it will 69 days from the expiry date foreclosure can be completed in the state of texas if its not a home equity loan.In Texas the foreclosure auction is held only once in a month on first tuesday.so sometimes you mught get 30 more days if you are lucky. but going thru the loss mit solution is the best way.

I live in South Carolina and my house payment is late 30 days. They are saying they can foreclose and even if I make a payment late that I cannot stop the foreclosure, but I havent received any papers at all. Can they really do that

Hi melissa,

Lenders, generally, do not foreclose if you are 30 days late. However, this late payment can be reported to the credit bureau and it will remain as a negative item on your credit report. Lenders foreclose the property if you are more than 90 days late.

i am 30 daays behind on my house payment and i recieved a notice of cure to default, whatb does that mean, and if i cant make a payment for another two weeks , what will probably happen

Hi frances,

A notice of cure to default explains the rights you have to cure your past due payments and be current on your loan. You're 30 days late already. If you're late on your payments for consecutive 90 days, the lender will send you a notice of default and will start foreclosure procedure on your home.

I just paid my June mortgage now it is July 17 and I am going to pay my July at end of month can they do anything or will this be okay

I was just told they are going to foreclose on my house and it's only 30 day past due on the 9th today is the 8th. Can they do this I live in birmingham, al. I even tried to tell them I could make the payment on the 15th. He said he would start forecloser on Monday the 11th.

daddyj i think you are dealing with an unscrupulous collector. there's not a lender in the country that would begin a foreclosure action after 30 days. have you spoken with anyone else at this lender's office? if you get this person on the phone again, insist on being transferred to a supervisor so you can express your concerns.

go ahead and make your payment next friday. lenders who have any sense are trying to work with their clients, not to abuse them. what you've received is abusive.

let this clown know that you realize he is violating the law and that you plan to contact the ftc. he'll back off in a millisecond.

ive been through bankruptcy almost two years ago and my mortgage lender tried to forclose but my lawyer showed them my receipts but they still put bankruptcy on my statement but now im going through financial difficulty and probaly will for the next four payments my question is can i make four late payments and not be forclosed on thank you ray

Hi ray,

Your mortgage may have been discharged through bankruptcy, but the lender still has the right to foreclose the property to satisfy the lien. Generally, if you are more than 2 months behind on your mortgage payments, the lender starts foreclosure proceedings against you. So, if you are 4 months behind on mortgage payments, your lender can foreclose on the property.

i have paid my payments every single month and i missed january but paid both january and febuary together and they rejected my payments without notification and started forclosure proceedings they say they will except my payments now but i have to pay the attorney fees is this legal help
