HELLO,
MY FATHER IS DECEASED. THERE WAS NO WILL. HE OWNED A HOME. THERE ARE SIX SIBLINGS ALL AGREE THAT THE THIRD SIBLING SHOULD STAY WITH HOME. WHAT SHOULD WE DO TO CHANGE OWNERSHIP.

my mother died in 1999.leaving no will.there is 4 other siblings.i have been paying taxes since 2000.can i get a deed in my name

Hi MBOTELLO,

You and your siblings will file an affidavit of heirship and get the property transferred in your names. Then all the siblings can sign a quitclaim deed and transfer the property to the third sibling.

dad passed 3 years ago left no will house is in a reverse mortgage mom would like to sell does she have to still get a affidavit of heirship to transfer
property to her name to sell if so can this be done thru county probate or county recorders thanks

Hi fernnado,

Your mother will have to file an affidavit of heirship at the county recorder's office in order to get the property transferred in her name. Then she can sell off the property.

Please do not file a quick claim deed. File a Special Warranty Deed.

Hi Sis groves,

I agree with you that filing a warranty deed is always a better option than filing a quitclaim deed. Warranty deed is much safer compared to any other deed.
