If we file bankruptcy in Texas can we leave out our mortgage. We can afford to keep paying it and want to protect my mom who co-signed. Also could we file chapter 7 if we pass the means test.

Though you file bankruptcy, you can leave out your mortgage. You don't have to include your mortgage dues in your bankruptcy filing. You will be able to file Chapter 7 if you pass the means test.

YES you do not have to include the mortgage when you file, but you should consider all options before you file for BK. It severely impacts credit.
