Chapter 7 discharge

We filed Chap7 in june of 08- We have a house in California, we live in Texas that we did not reaffirm on. Our Bk was discharged in 12/08 and we did not make any paymnts since then. The mortgage companies have already reported the loans as being included in our bk and discharged. They have since sold our loans to other companies and they are saying since our BK was in dec 08 and they ( The new companies ) just sent us notice in 3/09 that we are responsible for the debt. How can we be responsible if the debt was already counted against us in our chap 7?? Can they do this? And if they cannot, and continue to contact me, can I persue legal against them/

Just mail or fax them the BK documentation proving that the account were included in your banktruptcy.

Welcome to forums!

I completely agree with Chris Burns. As you have not reaffirmed the loans, you will not be responsible to pay them off anymore. They have been discharged as you included them in your Chapter 7. As Chris has said, you should fax all the documents related to bankruptcy which will let them know that you are not responsible for the loan anymore. You can also ask your bankruptcy attorney to deal with them.
