I heard on a seminar that in Texas, a borrower can obtain a Judicial, (Mortgage), or a Non-Judicial, (Deed of Trust), on a loan, however when I tried to finance my new home I was told by the attorney representing the lender that only "Deed of Trust" is available in Texas. Can you clarify?

Hi Parandslr,

In Texas, only the non-judicial Deed of Trust is available.

In Texas both mortgages as well as deed of trust are applicable.
