I live in Texas.. I have refinancing my home. I purchased it before I married now that I am married I am refinacing it but I am only financing it in my name.. Why does my husband have to sign papers and especially the deed? I dont want his name no where on it.. Is there anything I can do to stop it for happening?

Hi maillady,

Are you based at a community property state? If yes, then your husband may have to sign an interspousal transfer deed in order to relinquish his rights to the property. Thus, when you refinance the loan, it will be in your name and your husband will have no rights to the property or to the loan.

Thanks
