In Texas am I liable for mortgage after divorce if I am not on the mortgage, deed or trust?

I am going through a divorce. My soon to be ex husband bought a house right after we were married. The house is in his name only as my credit was not good enough at the time for me to be on the mortgage. He is asking that I pay for it too in the divorce. Can he do this? Will I be held responsible?

Hi Guest,

As your name is not on the mortgage or on the property deed, you shouldn't be held responsible for the mortgage. Your husband cannot force you to pay the mortgage dues. You can contact your lawyer and take the required steps against him.

Absolutely.

Not just Texas in any other state, if your name is not on the mortgage then you are not laible to pay the mortgage

My husband and his ex are on the mortgage and she deeded the house to him, then he put my name on the deed. Now I am going thru a divorce and I need to know if he can just take my name off the deed without my signature. Also, do I get any proceeds from the sale of the house.

As your name is on the property deed, your husband will not be able to remove your name without your signatures or your consent. If your husband sells off the property now, you would be able to claim your share of the property from the sale proceeds as your name is on the property deed.
