My wife and I are getting a divorce. She has a mortage on a house for which I signed the Deed of Trust but not the promissory note. As part of the divorce i must sign a special warranty deed to her giving up my rights to the property. If she were to default on the loan, would the bank be able to force me to pay the mortgage? If so, what should I do to be removed from the mortgage?

Hi clintemorgan!

Welcome to forums!

If your name is on the mortgage deed, then you would be responsible for the loan though you transfer your property to your wife. After you transfer the property, your wife will have to refinance the loan in her name to release you from the liability.
