I am trustee in my mothers will for my physically and mentally disabled sister. She is currently receiving medicaid and is in a nursing home. once the will is probated the amount will be 10m or less. I am told she will lose her medicaid elgibility for 3 years and the 10M would not cover her care for 6 mos. It is suggested she disclaim her share of the inheritance but we were hoping to use the money to offset some of the cost of her final expenses.
any suggestions ? she is a TEXAS resident

Who suggested your sister about disclaiming the property? I would suggest you to contact an attorney who is well versed in Medicaid laws and take his opinion. He would be the best person to guide your sister in this regard.
