I live in Texas and want to purchase a home; my husband and I are separated but not legally divorced. Can I get a loan without him signing any documents?

There shouldn't be any reason as long as you qualify on your own. Do you have a down payment saved up? Gainfully employed? Checked your FICO score lately?

If you're purchasing in Texas, a hand shake seperation won't fly. You would have to go through the whole divorce process. If you're moving out of state, depending on what state you're purchasing in will determine whether you need to include your husband or not. States that you're required to add your husband are considered community states.

Thanks for the reply; the scenario was not mine, however, your response matched my initial response to the inquirer.
