I would like to get a portion of the equity out and refinance. We owe around 43 and the house is worth 110.

You can check out with your current lender whether he is ready to refinance the property or not. If not then you can consult the other lenders of your area. However, I would suggest you to do some mortgage shopping before you do a refinancing. This will help you in knowing the present market rates and terms.
