in a community state (Texas) does my husband have to be on the title even if he is not on the mortgage? i am fixing to close on my first home and they are saying he has to be on the title even though he is in jail and soon to be deported.

Hi mvasquez,

As Texas is a community property state and you haven't divorced your husband, the lender has the rights to ask you to include your husband's name in the property deed.
