Transfer Deed from Both Spouses names to surviving spouse

I live in Texas. the loan for our home is in my name but the deed is in both of our names. My husband passed away two years ago but as we didn't have anything I didn't go to the expense of having the will probated. Is there anyway I can get the deed for the house transfered just into my name?

Hi china,

Since your deceased husband has left a will, the property needs to be probated in order to change the deed in your name. I don't think there is any other way to transfer the title in your name. You can file a death certificate with the county recorders. But I'm not sure whether that alone will help.

I live in texas my mortgage co. transfered the mortgage to me what do i need to do to transfer the deed to my name . we did not have a will

Hi, Mom. I was out here looking for info about your deed transfer, and I stumbled across your post. According to what I just saw on Just Answer.law, all you have to do is take a copy of the death certificate to the clerk and complete a quit claim deed. In Texas the estate automatically goes to the surviving spouse unless there is a will stating otherwise. Filling out the quit claim deed is a way of releasing the deceased spouses right to the property.
