My grandpa died and we've filed an Affidavit of Heirship with the county (in TX) for my grandma. All the comments I've seen here say to do that and get the property transferred to her but could I get more detail on how to do that part? Will it happen automatically with the Affidavit of Heirship or does she need to fill out other things with the county?

Hi sewuni,

The affidavit of heirship would be recorded at the county recorder's office. While she filed the affidavit of heirship, the county recorder's office will let her know whether or not she needs to fill out any other documents/forms.

Right, we took it to the county recorder and the lady said we needed a warranty deed. I then did research, leading me to this site, that said you can't do a warranty deed when the person has died and the affidavit should stand in it's place. I'm just curious if, once the affidavit is processed, the titles will automatically transfer to her name or if we need to go back with more paperwork (all of which we had taken with us and the lady there just looked at us like we were crazy).

You should get in touch with a real estate attorney and he would help you in better manner in this regard.
