My husband and I are filing a Chapter 13 in the Commonwealth of Virginia. If I choose to retire at...62, will the Trustee consider the social security payment as income to be provided to the creditors?

Hi rw45sharp!

Welcome to forums!

According to the federal exemptions in case of bankruptcy, you will have the right to receive social security, unemployment, VA benefits, welfare, and pensions, regardless of the amount. So, I don't think your social security income will be taken away in order to pay off your creditors.
