I am married but my name is not on mortgage or deed in Virginia. What would happen if my husband died without a will?

Hi

Since you are neither on the loan nor on the deed, you are not responsible for either the mortgage or the property. Under these circumstances, if your husband dies without a will, you'll be required to file an affidavit of heirship with the probate court to change the title in your name. As for the loan, you can just keep making the payments on time to avoid foreclosure on the house.
