My fiancee and I bought a mobile home together. We are currently in the process of breaking up. I have offered to have an agreement written up that we can both sign where as I will pay him half of what the house is worth if he will get his name taken off the title, also allowing him to live in the home until I am done paying him half (as I don't currently have enought to pay the bills and find a large sum of money). He refuses to do so. When we talk about it he says the only way I am getting his name taken off the home is if we sell it. I then offered to let him pay me off for the home and he could keep it and he refused that as well saying he doesn't want to keep the home. We owe my parents 12,000 for the home but have no legal documents of any sort stating such, which is why I would like to keep the home, even willing to pay him off for it (Together we haven't even put more than a few thousand in to it).

I want to know if I were to take him to court over the house what are the chances I would be able to keep it? Is there any other way for me to have him taken off the title? ( he occasionally change his mind and says he'll transfer it to me but I want to be prepared to take legal action if necessary)

We live in Washington.

As far as his rights to sale the home is concerned,he is perfectly OK on his stance as he is the owner (may be up to some% age ) of the home.Because his name is on the title.
Now the question comes about your parent's share!-although they have paid marginal amount while purchasing the home but there is no legal standing as such because they have paid it t o you as a donation/help.So in this scenario I doubt that you would be able to do anything in this issue with legal front.

So even though we both own it 50 50 you think my only way out of it is to sell it

Welcome to forums!

I can understand that you are in a difficult situation and your partner is not ready to cooperate with you. In such a situation, selling the property is the best option. You can file a partition lawsuit in the local court. The court will judge the whole situation and sell off the property. The sale proceeds will be used to pay off the mortgage or any other liens that you have on the property. If there is an excess amount, then it will be divided amongst both of you.
