I AM UNEMPLOYED SINCE JANUARY 2009. MY UNEMPLOYMENT CHECKS ENDED APRIL 2010. MY HUSBAND IS 76 YEARS OLD AND A PART TIME CASHIER IN THE SUPERMARKET. I AM 61 YEARS OLD AND CANNOT FIND EMPLOYMENT. MY MORTGAGE PAYMENT IS $1,019 A MONTH. I PAID $500 FOR AUGUST, SEPTEMBER AND OCTOBER. THEY APPLIED MY PAYMENTS TO THE INTEREST AND NOT TO THE MORTGAGE PAYMENT!! ON PAPER IT LOOKS LIKE I AM IN DEFAULT!!! WHAT IS THEIR PROBLEMS. THE LEFT HAND DOES NOT KNOW WHAT THE RIGHT HAND IS DOING. THEY SAY THAT DEFAULT IS NOT IMMINENT. THEY SAY I HAVE THE ABILITY TO PAY MY CURRENT MORGAGE PAYMENT USING CASH RESERVES OR OTHER ASSETS. I DO NOT HAVE THESE RESERVES AND ASSETS. WHAT ARE THEY TALKING ABOUT. THIS IS A HORROR STORY AND WE ARE LIVING IT!! WE ARE VERY STRESSED AND NOW WE ARE SERIOUSLY CONSIDERING NOT PAYING OUR NOVEMBER MORTGAGE (NOT EVEN A PORTION) YOU'RE DAMNED IF YOU DO AND DAMNED IF YOU DO NOT!!! THEY HAVE ALL OF OUR PAPERWORK AND OUR HARDSHIP LETTER. MY HUSBANDS INCOME DROPPED FROM $40,000, TO 27,000 AND THEN TO $20,000! THIS YEAR IT WILL PROABLY BE $15,000!! IF THAT IS NOT A FINANCIAL HARDSHIP, I DO NOT KNOW WHAT IS AT THIS POINT. EVEN IF I GET EMPLOYMENT, IT WILL BE FOR MINIMUM WAGE AT THIS POINT. I WILL STILL HAVE A HARD TIME PAYING MY MORTGAGE AT 7%. CONSIDERING HIRING A LAWYER.

Susan, I don't believe that a lawyer will be much benefit to you. If there is a NACA office nearby, you'd do well to discuss this with them. NACA has special relationships with most every lender, Wells included, and that helps them to get modifications and workouts accomplished.
That you may or not make your November payment isn't all that consequential, frankly, because your situation is not dissimilar to thousands of others, who are also seeking modifications...from Wells, BofA, Chase...on and on...the names are legion now.
If you can't get with NACA, try and hook up with CCCS or another of the non-profits that help folk...trying to do this on your own is tedious, difficult and most frustrating, I know; but with the assistance of one of these agencies, you'll have relief from lots of the annoyance that overtakes borrowers, and you will probably do much better than you even anticipated when you first began to think about seeking assistance. |
