How to file a quitclaim form State of AZ

Posted on: 24th Mar, 2009 02:22 pm
I live in Pinal County and am currently on the deed for the home my husband and I own. I am not on the loan and we are divorcing. I need to quitclaim the home back to him, but I am unsure of the process or where to get the form. I have looked on the government sites but don't see any forms available for this. I assume I must file with the Pinal County Recorder?

I currently live in the home and he has said he is going to stop paying the mortgage. That is a whole other story in itself...but for 2 years we have sought help on our VERY upside down home, but with excellent payment and credit history the banks don't care. Now that I must find my own home he cannot afford to pay it. The bank has told him to stop paying the mortgage if he wants help. I want to make sure that God forbid should something happen and he goes into foreclosure I won't be on any public documents saying that I was involved in the foreclosure of a home. I currently have an "excellent" credit rating and I want to make sure there aren't any black marks on it. Any help is appreciated.

Hi Kathykat!

Welcome to forums!

If you quit claim the property, it will only help you in getting rid of the property. You will still remain liable for the mortgage dues. If the property is foreclosed, it will affect your credit in a negative way. Unless your husband refinances the mortgage in his name, you'll be liable for the loan payments.

Feel free to ask if you've further queries.

My husband & I are residents in CA, own a vacant lot free and clear in Mohave County AZ. We are divorcing and he is quit claiming the lot to me. Is this something I can do online and in the mail without going to AZ?

Hi Caryl,

I don't think you will be able to do this online. You will have to go to the county recorder's office in order get the deed recorded in your name. Nevertheless, you can still contact a real estate attorney and take his opinion in this regard.

Thanks
