Bankruptcy and Divorce

My husband is considering filing Chapter 7. We have a pre-nup, but decided to refince our home one year after our marriage, with both of our names on the loan. All other debt is separate. We have no children together.

We have been married 2.5 years. I was disabled 2 years ago and have not been able to work. His credit is poor from a previous bankruptcy, mine is excellent. The only real debt I have is in the house which has no equity. I have contacted a divorce lawyer for advice. Any ideas?

If you have refinanced the property and if your name is on the mortgage documents, then you will be responsible for paying the mortgage dues. I think your credit will also be affected by the bankruptcy filed by your husband. However, there are various ways to avoid bankruptcy.
