Based on the above forum, I aslo in 2008 will have to file a 982 and claim insolvency. I filed bankrupcy after loosing my job, my main and only home was included as a forcolsure. I received a 1099A from the first lender. The house is now a Hud home selling for far less than the the fair market value. The second lender has sent nothing, and based a conversation, they will not. Can they come after me even if I filled Chapter 7 and included the 2nd mortgage company in the bankrupcy? And how am I to include them on the 982 if they do not send a form.
if you file for a chapter 7 bankruptcy, it stops the lenders from taking any sort of legal action against you be it collections, wage garnishment, foreclosure etc. they are not even allowed to make harassing calls to the debtors who have filed chpter 7.
